PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING THE WEBSITE.

Welcome to www.haasf1team.com (the "Website"). These terms of use ("Terms") form a legally binding agreement between you and Haas F1 Group ("TGR Haas F1 Team", “we”, “our” or “us”) relating to your use of the Website. Accessing and using the Website indicates that you have read, understood, accept and agree to comply with the Terms. The Terms apply to all users of the Website, including users who use any service on the Website. As set out below, some features of the Website may be subject to additional terms and conditions (such as the TGR Haas F1 Team Haas+ Terms and Conditions referred to below).

YOUR ATTENTION, IN PARTICULAR, IS DRAWN TO THE SECTION “EXCLUSION OF WARRANTIES / LIMITATION OF LIABILITY” UNDER THESE TERMS.

Accepting the Terms

You may not access and use the Website unless you agree to abide by these Terms. You understand and agree that TGR Haas F1 Team will treat your use of the Website as your acceptance of the Terms. If you do not accept the Terms, you must not use the Website, so please leave the Website immediately. You may not use the Website and may not accept the Terms if: (a) you are not of legal age to form a binding contract with TGR Haas F1 Team, or (b) you are a person who is either barred or otherwise legally prohibited from receiving or using the Website under the laws of the country in which you are resident or from which you access or use the Website.

Changes to the Terms

TGR Haas F1 Team may, at its discretion, amend these Terms from time to time or change, update or discontinue any aspect of feature of the Website without notice. When these changes are made, TGR Haas F1 Team will make a new copy of the Terms available here. You understand and agree that if you use the Website after the date on which the Terms have changed, TGR Haas F1 Team will treat your use as acceptance of the updated Terms. Every time you wish to use the Website, please therefore check these Terms to ensure you understand the terms that apply at the time.

TGR Haas F1 Team Accounts

In order to access some features of the Website, namely our TGR Haas F1 Team Haas+ programme, which is a free-to-join loyalty membership programme, that has been set up to provide fans with access to inside information, offers and exclusive content throughout an F1 season, you may have to create a user account. Please refer to TGR Haas F1 Team Haas+ Terms and Conditions, which governs your account and membership to TGR Haas F1 Team Haas+ programme.

Your access to and use of Website features

As expressly stated in these Terms, there are other terms that may apply to the Website and/or specific features of the Website, which you must agree to and comply with in order to use the Website and/or such features.

We may suspend or remove your access to the Website at any time without notice, including in response to a security incident.

You may not use the Website or any content on it:

1. in any way that breaches any applicable local, national or international law or regulation;

2. in any way that is unlawful or fraudulent or has any unlawful or fraudulent purpose or effect;

3. to bully, insult, intimidate or humiliate any person or for the purpose of harming or attempting to harm minors in any way;

4. to upload terrorist content;

5. to transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam);

6. to knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware;

7. to collect or harvest any information or data from the Website or attempt to decipher any transmissions to or from the servers hosting the Website; and/or

8. for any commercial purpose without obtaining a licence to do so from us or our licensors.

You also agree:

1. not to access without authority, interfere with, damage or disrupt any part of the Website, any equipment or network on which the Website is stored, any software used in the provision of the Website, or any equipment or network or software owned or used by any third party;

2. not to conduct, facilitate, authorise or permit any text or data mining or web scraping in relation to the Website or any services provided via, or in relation to, the Website for any purpose, including the development, training, fine-tuning or validation of AI systems or models;

3. not to use, and we do not consent to the use of, the Website, or any data published by, or contained in, or accessible via, the Website or any services provided via, or in relation to, the Website for the purposes of developing, training, fine-tuning or validating any AI system or model;

4. that we are the owner or the licensee of all intellectual property rights in the Website or any services provided via, or in relation to the Website, and in the material published on it. Such works are protected by copyright laws and treaties around the world. All such rights are reserved; and/or

5. that our status (and that of any identified contributors) as the authors of content on the Website must always be acknowledged.

Failure to comply with these Terms may result in us taking all or any of the following actions: 

1. immediate, temporary or permanent withdrawal of your right to use the Website;

2. issue a warning to you; or 

3. disclose of such information to law enforcement authorities as we reasonably feel is necessary or as required by law.

To the fullest extent permitted by law, we exclude our liability for all action we may take in response to your breach of these terms set out in these Terms. The actions we may take are not limited to those described above, and we may take any other action we reasonably deem appropriate.

Ownership of Content

All content on the Website including, without limitation, the text, software, scripts, graphics, photos, sounds, music, videos and interactive features on the Website is either owned by or licensed to TGR Haas F1 Team, and is subject to copyright, trade mark rights, and other intellectual property rights of TGR Haas F1 Team or TGR Haas F1 Team's licensors. Any third party trade or service marks present on the Website are trade or service marks of their respective owners. TGR Haas F1 Team reserves all right in and to this content. The content of the Website may not be downloaded, copied, reproduced, modified, stored, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any other purpose in any medium whatsoever without explicit prior written consent of TGR Haas F1 Team.

Certain areas of our Website may collect and use your personal information. For further details of how we use any of this information please see our Privacy Policy, and/or in the account specific privacy policy notified to you at the time of providing your information.

The Website may include hyperlinks to other websites that are not owned or controlled by TGR Haas F1 Team. TGR Haas F1 Team has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party websites. TGR Haas F1 Team encourages you to be aware when you leave the Website and to read the terms and conditions and privacy policy of each other website that you visit. You acknowledge and agree that TGR Haas F1 Team is not responsible for the availability of any such external sites or resources, and does not endorse any advertising, products or other materials on or available from such websites or resources. You acknowledge and agree that TGR Haas F1 Team is not liable for any loss or damage which may be incurred by you as a result of the availability of those external sites or resources, or as a result of any reliance placed by you on the completeness, accuracy or existence of any advertising, products or other materials on, or available from, such websites or resources.

Exclusion of Warranties/ Limitation of Liability

Nothing in the Terms shall affect any statutory rights to which you are always entitled as a consumer and that you cannot contractually agree to alter or waive. However, you acknowledge that the Website is provided on an "as is" or "as available" basis. TGR Haas F1 Team makes no warranty or representation, express or implied, to you with respect to the Website to the fullest extent permitted by law. The content on our Website is provided for general information only, and TGR Haas F1 Team does not represent or warrant to you that: (i) your use of the Website will meet your requirements; (ii) your use of the Website will be uninterrupted, timely, secure or free from error; (iii) any information obtained by you as a result of your use of the Website will be accurate or reliable; or (iv) defects in the operation or functionality of any software provided to you as part of the Website will be corrected.

We encourage you not to reproduce, duplicate, modify, copy or re-sell any part of the Website (or any services provided via, or in relation to it), including any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text. However, if you do, you acknowledge and agree that any content downloaded or otherwise obtained through use of the Website is done at your own risk and your are solely responsible for any damage done to your computer system or loss of data that results from the download of such content.

In no circumstances shall TGR Haas F1 Team or its suppliers be liable in any way whatsoever arising out of your use or inability to use the Website or access its content, even if TGR Haas F1 Team has been advised of the possibility of such damages. Without limiting the generality of the foregoing, TGR Haas F1 Team shall not be liable to you for:

1. any indirect or consequential losses including but not limited to loss of profit (whether incurred directly or indirectly), any loss of goodwill or business reputation;

2. any loss or damage which may be incurred by you as a result of:

   1. any reliance placed by you on the completeness, accuracy or existence of any advertising, or as a result of any relationship or transaction between you and any advertiser or sponsor whose advertising appears on the Website;

   2. any changes which TGR Haas F1 Team may make to the Website, or for any permanent or temporary cessation in the provision of the Website (or any features within the Website); 

   3. other communications data maintained or transmitted by or through your use of the Website; or 

   4. your failure to keep any passwords or account details secure and confidential.

Nothing in these terms shall exclude or limit TGR Haas F1 Team’s liability for losses which may not be lawfully excluded or limited by applicable law.

General

The Terms constitute the whole legal agreement between you and TGR Haas F1 Team in respect of your use of and access to the Website and replace any prior agreements between you and TGR Haas F1 Team in relation to the Website. You agree that if TGR Haas F1 Team does not exercise or enforce any legal right or remedy which is contained in the Terms (or which TGR Haas F1 Team has the benefit of under any applicable law) this will not be taken to be a formal waiver of TGR Haas F1 Team's rights and that those rights or remedies will still be available to TGR Haas F1 Team. If any court of law, having the jurisdiction to decide on this matter, rules that any provision of these Terms is invalid, then that provision will be removed from the Terms without affecting the rest of the Terms. The remaining provisions of the Terms will continue to be valid and enforceable.

You acknowledge and agree that each member of the group of companies of which TGR Haas F1 Team is a party shall be third party beneficiaries to the Terms and that such other companies shall be entitled to directly enforce, and rely upon, any provision of the Terms which confers a benefit on (or rights in favour of) them under the Contracts (Rights of Third Parties) Act 1999. Other than this, no other person or company shall be a third party beneficiary of the Terms. The Terms, and your relationship with TGR Haas F1 Team under the Terms, shall be governed by English law. You and TGR Haas F1 Team agree to submit to the exclusive jurisdiction of the courts of England to resolve any legal matter arising from the Terms. Notwithstanding this, you agree that TGR Haas F1 Team shall still be allowed to apply for injunctive remedies (or other equivalent types of urgent legal remedy) in any jurisdiction.

Governing law and jurisdiction

Subject to the paragraph directly below, these Terms, their subject matter and their formation, are governed by English law, and we both agree that the courts of England and Wales will have exclusive jurisdiction. 

If you are a consumer, you will benefit from any mandatory provisions of the law of the country in which you are a resident. Nothing in these Terms, including the paragraph above, affects your rights as a consumer to rely on such mandatory provisions of local law. 

If you are a business, these Terms, their subject matter and their formation (and any non-contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales.
